Terms of Service

By accessing or using B AI VIDEO (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We may update these Terms from time to time. The "Effective" date at the top of this page reflects the latest revision. Continued use of the Service after a change indicates acceptance of the updated Terms.

B AI VIDEO provides a pay-per-use AI video generation tool. You upload a photo and a text prompt, and the Service attempts to produce a short AI-generated video based on that input. Output is best-effort and may not always match your expectations.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. Where reasonably possible, we will try to honor credits you have already purchased.

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

The Service uses a cookie-based anonymous studio identifier to track your credit balance. You are responsible for keeping your browser and device reasonably secure. We are not liable for losses resulting from unauthorized access to your browser session.

Credits are non-transferable and have no cash value. We may, at our sole discretion, refund unused credits if we discontinue the Service or if required by law.

Payments are processed by a third-party payment processor. By purchasing credits, you agree to that processor's terms of service in addition to these Terms.

Failed video generations (for example, due to upstream provider errors or content policy violations of the source image) will automatically return the credit to your studio balance. We do not offer cash refunds for credits that have been successfully used to generate a video.

If you believe a charge is erroneous, please contact us within 30 days and we will review the request.

You agree not to use the Service to: (a) generate content that is illegal, defamatory, harassing, or harmful; (b) impersonate any real person without their consent; (c) create non-consensual intimate imagery; (d) infringe the intellectual property or privacy rights of any third party; or (e) attempt to bypass rate limits, abuse promotional offers, or otherwise exploit the Service in bad faith.

We may use automated content safety checks provided by our AI generation partner. We reserve the right to refuse service for inputs that violate this section, with or without notice.

You retain ownership of the photos and prompts you upload. By submitting content, you grant us a limited, non-exclusive, royalty-free license to process that content via our AI partners for the purpose of operating the Service and delivering your video.

Generated videos are produced by third-party AI models. We make no claim of authorship over the output, and we provide no warranty that the output is free of similarities to other content produced by the underlying models.

The Service, including its design, code, branding, and copy, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted by these Terms.

The Service depends on third-party infrastructure, payment, and AI providers. We are not responsible for the availability, accuracy, or content of any third-party service, and your use of such services is at your own risk and subject to their respective terms.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that generated videos will meet your expectations, be free of artifacts, or be suitable for any particular purpose.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

Our total cumulative liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your uploaded content, or your violation of these Terms.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination will do so.

These Terms are governed by the laws applicable to the entity operating the Service, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Service will be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection laws in your country of residence provide otherwise.
